Terms of Use
These terms apply when you use Noteday on iPhone, iPad or Android. By installing or using the app, you agree to them. If you do not agree, please do not use the app.
1. Who we are
Noteday is provided by Gambit Global LTD ("we", "us"). You can reach us any time at info@gambitgg.com.
2. Your notes are yours
You keep all rights to everything you write, draw, import or record in Noteday. We claim no ownership over your content and we do not read it. Your notebooks are stored on your device; see our Privacy Policy for the detail on what does and does not leave it.
You are responsible for your own content, including having the right to import any PDF or image you bring into the app.
3. Licence to use the app
We grant you a personal, non-exclusive, non-transferable licence to use Noteday on devices you own or control, in line with the rules of the store you installed it from. You may not resell the app, reverse engineer it, or attempt to bypass its purchase or usage limits.
Artwork, templates, fonts, icons and cover designs inside Noteday remain ours or our licensors'. You may use them inside your own notebooks and export or share those notebooks freely. You may not extract, redistribute or resell the artwork on its own.
4. Free tier, Noteday Pro and one-time purchases
Free tier. Noteday is free to use with a limit on the number of editable notebooks, and it shows ads.
Noteday Pro is an auto-renewing subscription. It removes ads, lifts the notebook limit and includes a monthly allowance of AI credits. Current pricing is shown in the app before you buy, in your local currency.
- Payment is charged to your Apple ID or Google account at confirmation of purchase.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription in your device account settings at any time.
- If a free trial is offered, any unused portion is forfeited when you buy a subscription.
One-time purchases. Cover packs, template packs and individual covers and templates are bought once and stay yours on the same store account. Use "Restore Purchases" in Settings to bring them back on a new device.
5. AI credits
Noteday AI runs on our servers and is metered in credits. Each AI action shows its credit cost before you confirm it.
- New accounts receive a small number of welcome credits.
- Noteday Pro includes a monthly credit allowance. Unused monthly allowance does not roll over.
- Credit packs are one-time purchases. Purchased credits do not expire while your account is active.
- Credits have no cash value, cannot be transferred between accounts, and cannot be exchanged for money.
AI output can be wrong. Do not rely on it for medical, legal, financial or other professional decisions. You are responsible for checking anything important before you act on it.
To use AI features you sign in with Apple or Google. We may apply fair-use limits to protect the service from abuse, and we will tell you in the app if a limit applies to you.
6. Refunds
Purchases are processed by Apple or Google, so refunds are handled under their policies, not by us directly. On iOS use reportaproblem.apple.com; on Android use the Google Play order history. If something went wrong on our side, write to us and we will help.
7. Acceptable use
Do not use Noteday to break the law, to store or generate content that harms others, or to attack, overload or probe our services. We may suspend access to the AI service if we detect abuse.
8. Availability and changes
We work to keep Noteday available and improving, but we do not promise uninterrupted service. Features may change, and features that depend on outside providers may change with them. If we make a change that materially reduces something you paid for, we will tell you in the app.
9. Ending the agreement
You can stop using Noteday at any time by deleting the app; deleting it removes the notebooks stored on that device. You can delete your Noteday AI account, and the data attached to it, from Settings in the app. We may end your access if you seriously or repeatedly breach these terms.
10. Liability
Noteday is provided "as is". To the extent the law allows, we are not liable for lost data, lost profits, or indirect or consequential loss. Nothing here limits liability that cannot be limited by law. Keep your own backups of anything you cannot afford to lose.
11. Apple and Google
Apple and Google are not parties to these terms and are not responsible for Noteday. On iOS, Apple's standard Licensed Application End User Licence Agreement also applies, and where it conflicts with these terms, it wins for the iOS app.
12. Governing law
These terms are governed by the laws of England and Wales, without affecting any consumer rights you have where you live.
13. Changes to these terms
We may update these terms; the "last updated" date above will change. Continuing to use the app after an update means you accept the new terms.
